Insist on Your Right to Education

Uneducated citizenry is like a pitch any game can be played on it. Illiteracy is what has given the politicians in Ghana the chance to fool so many people for so a long a time.

Carl Wilson's acts shameful to Ghana's integrity-Manhyia MP

Dr Mathew Prempeh
Dr Mathew Prempeh
Member of Parliament for Manhyia is not impressed with the mere sack from office of Carl Wilson, Chairman of the Confiscated Vehicle Allocation Committee.

Dr Mathew Opoku Prempeh said the enormity of his offence has caused great embarrassment to the nation, and to repair that integrity, the stolen motorbikes confiscated by authorities of the Tema Ports but which was later sold to other people under the supervision of Carl Wilson, must be returned to their rightful owners.

Carl Wilson has for the past weeks made headlines for all the wrong reasons with allegations of car and motor bike fraud at the Tema Harbour hanging around his neck.

Each time the allegations came up, deputy Chief of Staff, Alex Segbefia rose to his defence, demanding evidence of wrong doing from his accusers before government could act.

On Thursday, news about his sack was announced but not after a group of disgruntled NDC sympathisers locked up the offices of the party’s national headquarters demanding the immediate dismissal of Carl Wilson.

By mere coincidence, Head of Communications at the presidency Koku Anyidoho told Joy News the Chairman of the Confiscated Vehicle Allocation Committee had been sacked three days ago, insisting, the action by the angry mob had nothing to do with the sack.

However, the Manhyia MP who has for weeks been blowing the whistle of corruption and abuse of office against Carl Wilson is not convinced by the explanations of Koku Anyidoho. He told Joy News’ Araba Koomson on Top Story that he is “ashamed” government took action only after being coerced by angry party mob.

He said the evidence of Carl Wilson’s corrupt practices was palpable and had made several attempts, including a question on the floor of Parliament, to draw government’s attention to the rot at the Tema Ports.

Mr Prempeh said the stolen motor bikes entered into the country early last year and with the ownership of the bikes in dispute it was confiscated by port authorities only to be resold by Carl Wilson.

Through Interpol, he said the ownership of the bikes was traced to the city of London, adding he had knowledge of the true owners of the bikes.

According to him, one of the owners flew down to Ghana from UK to repossess his £15,000 bike, only to be told it had been taken over by Carl Wilson.

“I have evidence that police in London requested the Ghana security apparatus to return those bikes to their lawful owners in London,”

“I have a list of the chassis and engine numbers of these numbers and their owners name and addresses.

These overwhelming evidence not withstanding, he said the bikes were resold to cronies and friends of Carl Wilson.

One of the bikes, he said was traced to Benin, with the new owner claiming to have bought it from Accra.

He charged the president to wage a crusade against the importation of stolen cars and motor bikes, just as he is doing for cocaine and other drugs.

SFO Are Comedians: Kofi Jumah

IS THIS A CRY FROM A CORRUPT AND INCOMPETENT POLITICIAN?

Jumah Maxwell

A former Chief Executive of the Kumasi Metropolitan Assembly (KMA), Maxwell Kofi Jumah, has rubbished claims by the Kumasi Serious Fraud Office (SFO), accusing him of re-allocating a building site designated to the Ghana Traditional Caterers Association (GTCA) to a different firm, the All State Construction Limited.

Speaking on an Accra-based radio station, Oman FM yesterday, Mr. Jumah unequivocally described the SFO as comedians, which come out to only entertain the public when “Agya Koo’s comic movies had run out of the system,” and told the host of the programme to brush aside the story, and talk about what he termed as something better.

“If SFO is investigating the matter, they should include the Squadron Yard and the FBI, I am waiting for them,” he stated. Mr. Jumah, currently the Member of Parliament (MP) for Asokwa, is said to have illegally re-allocated the site to one Kingsley Nana Asante of All State Construction firm, for the construction of a shopping mall on a Build-Operate and transfer basis.

The findings of the SFO indicated that a Memorandum of Understanding, dated September 30, 2003, was signed between the KMA and All State Construction Limited.

The document was signed by the then Metro Chief Executive without a name, with the then Metro Coordinating Director, Albert Anthony Ampong, and Metro Engineer, Charles Apomah Mensah, as witnesses. The SFO, in its recommendation, outlined that the Ghana Traditional Caterers Association took over the building located at the Kejetia from the All State Construction, which had forcibly and illegally possessed the property.

Further on the radio show, he said Kejetia was a lorry park run by the KMA, and nobody else, recalling that under former president Jerry John Rawlings, the World Bank assisted the then government with a loan to reconstruct Kejetia, but insisted that the traders be given a befitting location before being ejected. “What happened was that the Queenmother of the Kumasi Chop Bars Association was married to a former KMA boss’ sibling, and so she was given a piece of land to resettle the chop bar operators,” he explained, adding that the Queenmother, whose name he did not mention, rented the stores she had erected on the said piece of land out to banks and other business operators, and pocketed the money.

Continuing, he said the Queenmother came back, requesting for another piece of land, to which, he (Mr. Jumah) objected, and told her that until she had made plans to give back those stores to the rightful owners (chop bar operators), her demand would not be met.

He noted that another area was given to one Kingsley Nana Asante of All State Construction, who was supposed to develop the area, on condition that the stores would be allocated to any interested person, other than the chop-bar operators.

Mr. Jumah argued that the Kumasi Chop Bar Association’s Queenmother wanted to use any means possible to hold onto the whole of Kejetia, but, according to him, “as long as I live, it will never happen in and out of KMA, challenging her to produce documents to back her claims. “We should be fair and tell the truth, she had committed a lot of things which ought to have sent her to jail,” he expressed angrily. Asked by the host if he had no regrets over what he was accused of, the Asokwa MP concluded, “I did a thorough job, I still stand by it.”

Meanwhile, the SFO has upheld that the rule of law should take its course, directing the KMA to maintain the decision of a Kumasi High Court, which entered judgment on November 22, 2006, in favour of the GTCA.

It said the proper action must be taken to protect the interest of the state in general, and specifically that the KMA. The recommendation follows intensive investigations into the illegal takeover of the project, which had originally been allocated to the GTCA in 2000, with express approval of the then Regional Minister, Mr. Samuel Nuamah Donkor.

How Kufuor and Anane Doomed Ghana Airways

Source: The Enquirer

A comprehensive document in the possession of The Enquirer points to the fact that the bane of the Ghana International Airline (GIA), in the current ugly situation, is attributed to the haphazard manner the new Patriotic Party (NPP) government handled the liquidation and sale of the national airline, Ghana Airways, in 2005.

The government at the time engaged the services of PriceWaterhouseCoopers in 2004 to design a business plan for the liquidation of Ghana Airways, but it did not go by the plan, which, insiders say, was the best for the sale of the airline.

According to the PriceWaterhouseCoopers’ plan, dated April 22, 2004, submitted to the then Minister of Road and Transport, Dr Richard Anane, after the liquidation of Ghana Airways, the new one that will be in operation should be a privately owned, and will be funded by a total opening investment of $55 million, consisting of $25 million cash equity and $30million of debt.

Interestingly, the GIA, which the NPP government gave out Ghana Airways to, brought in only $2.1million towards the takeover of the national airline.

Even with that token sum, the GIA, under strange circumstances, withdrew $1.9 from its account and paid it to Sentry Financial Corporation, the company that provided the initial capital on behalf of GIA USA LLC.

The move, which took place on June 27, 2005 was concealed from the Government of Ghana for two clear weeks before it camp up for discussion at a board meeting.

The plan that was designed by PriceWaterhouseCoopers made it clear that the Government of Ghana was by the minority shareholder of the airline that would be established.

Unfortunately, that advice too was simply thrown to the dogs, as the government, in clear contravention, became the majority shareholder in GIA, with a 70 per cent share.

Again, the government provided an amount of $4.9 million, as against what was stated in the plan that the GIA should provide all the financial needs for the new business. The plan created room for absorption of 500 employees of the defunct Ghana Airways, but that was not to be.

Currently, pilots of Ghana Airways that were trained to handle Boeing aircraft are idle, because of the wet lease agreement between the GIA and Astraeus Airlines.

The plan by PriceWaterhouseCoopers stated clearly that contract between the Government of Ghana and GIA should be based on strict performance measures that would ensure that the new company was bound to perform.

In addition to that, the contract was to specify the potential remedies due to the Government of Ghana should the company fail as a result of lack of proper management of matters within its control. Surprisingly, GIA presently is performing badly and it is choking with huge debt.

As at April this year, the airline was indebted to the government and other creditors to the tune of $60.8million.

The currently National Democratic Congress (NDC) has so far supported the airline with $3million, covering January and February, this year. The government, presently, finds the operation of the airline unprofitable and has therefore suspended the subsidy and is taking steps to evaluate the airline’s operations since the financial support is unsustainable.

Before the NDC took over the reins of government, funds that were made available to GIA by the government, usually on a monthly basis, were treated as loans, but there were no written agreements between GIA and the government. As a result, there is no evidence that the loan-related costs reflected in the GIA accounts.

The GIAL was formed in 2005, with the government of Ghana having 70 per cent shares while the 30 per cent went to GIA-USA. Managing of the company was however ceded to the minority shareholder under a signed agreement.

It started operations in October 2005, with a singly wet-leased aircraft on the Accra-London route, but the government at the time dismissed the minority appointed Chief Executive Officer on April 7, 2006, resulting in the minority refusing to take further part in the management of the company.

GIA-USA, the minority shareholders, took the matter to the International Court of Justice at The Hague in the Netherlands and the case has become a legal quagmire as of date.

Akufo-Addo is Unattractive; He Cannot Attract Floating Voters

Akufo-Addo may have succeeded in getting his surrogates such as Jake Obetsebi Lamptey, Anthony Karbo, Mocta Bamba and co. to hijack the NPP national executive positions from the Ashanti faction, but it does not seem like Akufo-Addo will have his way when it comes to electing a flagbearer for the Party.

Not hiding their ill-feeling towards Akufo-Addo and his Akyem faction, the Ashanti faction is fighting tooth and nail to make sure that Akufo-Addo does not lead the Party into another electoral defeat.

Stephen Amoah, a failed National youth organizer aspirant, and a key member of the Alan Cash Ashanti faction, has stated emphatically that Akufo-Addo does not have an attractive personality and also does not have the capacity of attracting floating voters.

Speaking on Asempa FM, Stephen Amoah said that Alan Cash is more handsome and likeable candidate as compared to Akufo-Addo. “It is common knowledge that Alan is more attractive to floating voters than Akufo Addo and so it makes sense that we should throw our weight behind the most attractive person,” Stephen Amoah said.

According to Stephen Amoah, the consensus within the youth wing of the NPP is that, Allan Cash will attract more floating voters and that should Akufo-Addo become flagbearer, the NPP is doomed. Stephen Amoah, the failed Youth Organizer, spoke in support of Maxwell Kofi Jumah, who was reported in yesterday’s Insight newspaper to have also made the point that Akufo-Addo would not be allowed to become the flagbearer of the NPP.

According to the Insight story, Kofi Jumah was cock sure that Allan Cash will become the flagbearer of the NPP. Indeed, Kofi Jumah, speaking on the same programme yesterday reiterated the point when he was called to throw more light on the Insight story.

According to Kofi Jumah, Alan Cash is a savvy politician who has put in place strategies and structures to make sure that Akufo-Addo does not succeed in using any guerilla tactics to become flagbearer as happened the last time the Party gathered in Legon to elect a flagbearer.

Interestingly, Stephen Amoah, afraid of Akufo-Addo militants said that he hoped that he would not be victimized should Akufo-Addo lose the flagbearership race.

Kwabena Agyepong: Mills Is Not Physically Fit To Travel

Is it the reason why we are seeing any improvement in Ghana?

Kwabena Agyepong

A former Spokesperson to former President John Agyekum Kufuor, Kwabena Agyepong, says President Mills has failed to attend some critical international assignments outside the country because he is physically not strong enough to embark on such trips.

Kwabena Agyepong told Citi Breakfast Show host Moro Awudu, on Thursday, March 25 that the Vice President had to step in for him and attend several important occasions such as the AU summit because the president’s health could not support him to undergo the strenuous activities involved in such trips.

“How many times has John Mahama been out? A lot of times...Mills can’t do it because he is physically not able to do it and that’s why even important occasions like Africa Union the Vice President had to go...He can’t do the strenuous work that Kufuor had to do” The President’s health has been a major source of concern to many since the electioneering campaign in 2008.

It is recalled that shortly after his nomination as the NDC’s flagbearer for the 2008 elections, NDC’s MP for Lower Manya Krobo, Hon. Teye Nyaunu called for the replacement of then candidate Mills because he thought he was not fit enough to run the race.

At the time of his campaign, the NDC slammed former President Kufuor for embarking on numerous travels while neglecting his duties at home.

Kwabena Agyepong chided the NDC for what he called the hypocritical stance on the matter.

He suggested that President Mills’ inability to travel is not because he wants to keep to a campaign promise of cutting down presidential travels to save cost but rather he is too frail to meet the energy demands of such trips.

“There is no shame about that (that president Mills is sick) we don’t wish ill for anybody...as we speak President Mubarak is undergoing treatment in Saudi Arabia, he is sick. Reagan underwent several operations, why are we being so fetish about the issue?

He alleged that President Mills is benefiting from some state largesse including a parcel of state land at Amasaman.

“Professor Mills cannot tell me that he has not benefited from State largesse by having a plot. The plot at Amasaman, that’s where he is building his house. You should go and ask him whether that is not a state property.” He said

“Today he can look into the eyes of Ghanaians and said that Muntaka is not the only person to have travelled with the girlfriend. The man who is God fearing is now accepting the fact that Ministers can have extra marital activities.”

“Ama Benyiwa Doe and the rest, according to reports in the papers are building mansions within one year. They should not pretend that they are saints and then damage people just to get into office and do worse.” He added.

Meanwhile, the Communications Director to the presidency, Koku Anyidoho, responding to Mr. Agyepong's claims dismissed the assertion that the President is unable to travel because he is unfit.

He told Citi FM's Patrick Ayumu that Mr. Agyepong's claims are unjustified.

"The President was in Abuja. Last year he attended quite a number of international assignments - the climate change conference in Copenghagan, the UN General Assembly, the AU summit in Libya, he was at the Ecowas summit in Abuja, he was in Trinidad and Tobago for the Commonwealth heads of states meeting. We are only in the first quater of this year, and he didn't attend the AU summit in Adiss Ababa and that is enough to draw a conclusion? I don't think that is a justifiable conclusion.

Anane Others For Court Over Ghana International Airlines

Holding former public officials to account is good for Ghana's democracy and development

Anane 02.08

Ten persons including former Roads and Transport Minister Dr. Anane currently under investigations by the police are to be charged for various offences against the state by Monday.

The ten including other former ministers of state are said to have given caution statements to the police in connection with their roles in the failed Ghana International Limited (GIAL) venture.

It is believed they will face charges ranging from stealing, defrauding the state and causing financial loss to the state.

Difficulties occasioned by the technicalities in serving the legal processes on sitting MPs by the Police caused a delay in the commencement of the prosecution of this case. However it has been confirmed that Dr. Osei Akoto and Dr. Anane have now been formally invited to the Police station for questioning

Consequently Dr. Anane is currently being questioned at the Police headquarters over his role in the failed Ghana International Airlines. One particular allegation against him is that he misled Cabinet into approving a partnership with Ghana International Airlines at a time when Ghana International Airlines did not exist.

Chief, Fetish Priest Killed...As Land Guards Clash In Denkyira

General News of Tuesday, 23 March 2010 Source: GNA Chief murdered in Tamale by angry youth
Tamale, March 23, GNA - The Chief of Garezegu, suburb of the Tamale Metropolis, Yakubu Andani, was murdered on Monday at about 1900 hours by a group of angry youth.

____________________________________________________________________

The two above headlines greeted Ghanaians on 23rd December 2010. Let's hope this "SAA SEBEN LEAVERS" administration do not temporize as it is known to do and act immediately to bring law and order in these areas so that the citizens of those two towns can go about their daily chores without fear.
About two weeks ago before Asantehene issued his threats to arrest Techimanhene if the government fails to act and address the Tuobodomhene's kidnapping, I wrote an article about President Mills presiding over a Banana Republic due to the breakdown of law and order in Ghana and received tongue lashing from the usual sycophantic NDC zealots. Three days later, Asantehene was so miffed he lost his cool and threatened to nab Techimanhene like a hawk grabbing a fowl if the government fails to act. I know some people were not enthused at the way Asantehene acted but it got the government to get up from its 'fanny' and start ruling as it was voted to do.

Fellow Ghanaians, this is not an article about Asantehene and Techimanhene, who is right and who is wrong but as people with a common destiny, we have to realise that, there is a complete breakdown of law and order in Ghana because we've elected an "ASOMDWEHENE" who has failed miserably to act as a President and rather is acting like a Roman Catholic Cardinal extorting us to 'fast' constantly while he and his schoolboys Ministers are living large on our scanty resources. Just yesterday the deputy Information Minister, Ablakwa Okudzeto was all over the airwaves proclaiming that NDC in just fifteen months in Office has created 1.6 million jobs. I will leave this stupid utterance from a beaver tooth Okudzeto alone and concentrate on Mills presiding over a country coming apart at the seams.

The report coming from Tamale about the killing of another Tamale Chief is exiguous but the synopsis of it is that, the youths of that town near Tamale didnot like their newly installed chief so they decided to kill him like killing a goat without any regard to human sanctity. Is that what this country has come to? Since the assumption of office byPresident Mills, it seems like the law of the jungle is what is pertaining in Ghana because we have a lancourPresident who seems not to know what he is elected to do or he is still waiting for somebody to hand him the functions of what a President is supposed to do. How can a Chief kidnap another chief in Ghana and then proclaim that his Party is in power and for ten good days, not a whimper was heard from this moribund administration in a morbid kidnapping episode?

The capital city, Accra has not been sparred of this chieftancy nonsense either because this administration has chosen to play kingmakers in the Ga Mantse stool. The Ga Mantse is now at loggerheads with Mills administration and and now a sub chief from Weija Accra was murdered by languards because there is no fear from any section of the country of this administration where those supporting NDC have taken the law into their own hands and meting out their own jungle justice without this administration doing anything about it. The same day these two chiefs' were killed, NDC youths in another northern town seized NHIS office like the NDC youth in Dunkwa did a couple of weeks ago.

Carl Wilson, a known car thief is now working from the castle as the car seizing Czar despite evidence that, this Togolese thief stole a car and has it painted in the middle of the night. Now stolen Motorbikes from England has vanished from the port like the cars Carl Wilson and his boss Alex Segbefia are colluding and stealing from the port. Now the Brits and the Interpol are in Ghana looking for the bike thieves, what a disgraceful government.

In Atta Mills Ghana, our lives are in danger due to breakdown of law and order and our properties are not safe either as they are being confiscated and appropriated by the thugs operating from the Osu Castle. Ghanaians did not vote for this lawless government masquerading as "Asomdwehene" while in actual fact it it is a reckless government that has ceded its power to the thugs who used to be armed robbers. Let's face facts, do you think the same NDC idiots would be behaving like this if Rawlings was the President? I don't like the murderer but at least he instilled fear in his armed robbing supporters.

Vatican axed trial for priest accused by deaf boys

VATICAN CITY – The Vatican on Thursday strongly defended its decision not to defrock an American priest accused of molesting some 200 deaf boys in Wisconsin and denounced what it called a campaign to smear Pope Benedict XVI and his aides.

Church and Vatican documents showed that in the mid-1990s, two Wisconsin bishops urged the Vatican office led by then-Cardinal Joseph Ratzinger — now the pope — to let them hold a church trial against the Rev. Lawrence Murphy. The bishops admitted the trial was coming years after the alleged abuse, but argued that the deaf community in Milwaukee was demanding justice from the church.

An American protester in Rome on Thursday called the Murphy case an "incontrovertible case of pedophilia."

Despite the extensive and grave allegations against Murphy, Ratzinger's deputy at the Congregation for the Doctrine of the Faithruled that the alleged molestation had occurred too long ago and that Murphy — then ailing and elderly — should instead repent and be restricted from celebrating Mass outside of his diocese.

The official, Cardinal Tarcisio Bertone — now the Vatican's secretary of state — ordered the church trial halted after Murphy wrote Ratzinger a letter saying he was ill, infirm, and "simply want to live out the time that I have left in the dignity of my priesthood."

The New York Times broke the story Thursday, adding fuel to a swirling scandal about the way the Vatican in general, and Benedict in particular, have handled reports of priests raping children over the years.

On Thursday, a group of Americans who say they were sexually abused by clerics staged a press conference outside St. Peter's Square in Rome to denounce Benedict's handling of the case and gave reporters church and Vatican documents on the case.

Afterward, Italian police detained four Americans for 2 1/2 hours because they didn't have a permit for the news conference and suggested they get a lawyer in case a judge decided to press charges, the Americans said.

"We've spent more time in the police station than Father Murphy did in his life," Peter Isely, the Milwaukee-based director of SNAP, the Survivors Network of those Abused by Priests, said after his release.

Speaking at the earlier press conference, Isely called the Murphy case the most "incontrovertible case of pedophilia you could get."

"The goal of Cardinal Ratzinger, now Pope Benedict, was to keep this secret," he said, flanked by photos of others who say they were abused and a poster of Ratzinger. "We need to know why he (the pope) did not let us know about him (Murphy) and why he didn't let the police know about him and why he did not condemn him and why he did not take his collar away from him."

The Vatican issued a strong defense in its handling of the Murphy case. The Vatican newspaper L'Osservatore Romano said there was no cover-up and denounced what it said was a "clear and despicable intention" to strike at Benedict "at any cost."

The Vatican spokesman, the Rev. Federico Lombardi, issued a statement noting that the Murphy case had only reached the Vatican in 1996 — some 20 years after the diocese first learned of the allegations. He also said Murphy died two years later — in 1998 — and that there was nothing in the church's handling of the matter that precluded any civil action from being taken against him.

In fact, police did investigate the allegations at the time and never proceeded with a case, Lombardi noted. He said in the statement that a lack of more recent allegations was a factor in the decision not to defrock Murphy and noted that "the Code of Canon Law does not envision automatic penalties."

Murphy worked at the former St. John's School for the Deaf in St. Francis from 1950 to 1975. His alleged victims were not limited to the deaf boys' school. Donald Marshall, 45, of West Allis, Wisconsin, said he was abused by Murphy when he was a teenager at the Lincoln Hills School, a juvenile detention center in Irma in northern Wisconsin.

"I haven't stepped in a church for some 20 years. I lost all faith in the church," he told The Associated Press in an interview Thursday. "These predators are preying on God's children. How can they even stand up at the pulpit and preach the word of God?"

Church and Vatican documents obtained by two lawyers who have filed lawsuits alleging the Archdiocese of Milwaukee didn't take sufficient action against Murphy show that as many as 200 deaf students had accused him of molesting them, including in the confessional, while he ran the school.

While the documents — letters between diocese and Rome, notes taken during meetings, and summaries of meetings — are remarkable in the church officials' repeated desire to keep the case secret, they do suggest an increasingly determined effort by bishops, albeit 20 years later, to heed the despair of the deaf community in bringing a canonical trial against Murphy.

Ratzinger's deputy, Cardinal Tarcisio Bertone, though, shut the process down after Murphy wrote Ratzinger a letter saying he had repented, was old and ailing, and that the case's statute of limitations had run out.

"I have just recently suffered another stroke which has left me in a weakened state," he wrote Ratzinger. "I have repented of any of my past transgressions, and have been living peaceably in northern Wisconsin for 24 years. I simply want to live out the time that I have left in the dignity of my priesthood."

"I ask your kind assistance in this matter," he wrote the man who would be pope within a decade.

According to the documentation, in July 1996, then-Milwaukee Archbishop Rembert G. Weakland sent a letter seeking advice on how to proceed with Murphy to Ratzinger, who led the Congregation for the Doctrine of the Faith from 1981 until 2005, when he was elected pope.

Weakland explained that he was writing because he had only recently learned that the reason Murphy stopped working in 1975 was because he had been accused of soliciting sex in the confessional, one of the gravest sins in canon law.

Weakland received no response from Ratzinger, and in October 1996 convened a church tribunal to hear the case.

In March 1997, Weakland wrote to the Vatican's Apostolic Signatura, essentially the Vatican high court, asking its advice because he feared the statute of limitations on Murphy's alleged crimes might have expired.

Just a few weeks later, Bertone told the Wisconsin bishops to begin secret disciplinary proceedings against Murphy according to 1962 norms concerning soliciting sex in the confessional, according to the documents.

But a year later, Bertone reversed himself, advising the diocese to stop the process after Murphy wrote to Ratzinger. Bertone suggested that Murphy should instead be subject to "pastoral measures destined to obtain the reparation of scandal and the restoration of justice."

The archbishop then handling the case, Bishop Raphael Fliss, objected, saying in a letter to Bertone that "I have come to the conclusion that scandal cannot be sufficiently repaired, nor justice sufficiently restored, without a judicial trial against Fr. Murphy."

Fliss and Weakland then met with Bertone in Rome in May 1988. Weakland informed Bertone that Murphy had no sense of remorse and didn't seem to realize the gravity of what he had done, according to a Vatican summary of the meeting.

But Bertone insisted that there weren't "sufficient elements to institute a canonical process" against Murphy because so much time had already passed, according to the summary.

Weakland, likening Murphy to a "difficult" child, then reminded Bertone that three psychologists had determined he was a "typical" pedophile, in that he felt himself a victim.

But Bertone suggested Murphy take a spiritual retreat to determine if he is truly sorry, or otherwise face possible defrocking.

"Before the meeting ended, Monsignor Weakland reaffirmed the difficulty he will have to make the deaf community understand the lightness of these provisions," the summary noted.

The documents contain no response from Ratzinger.

The documents emerged even as the Vatican deals with an ever-widening church abuse scandal sweeping several European countries. Benedict last week issued an unprecedented letter to Ireland addressing the 16 years of church cover-up scandals there. But he has yet to say anything about his handling of a case in Germany known to have developed when, as cardinal, he oversaw the Munich Archdiocese from 1977 to 1982.

After Murphy was removed from the school in 1974, he went to northern Wisconsin, where he spent the rest of his life working in parishes, schools and, according to one lawsuit, a juvenile detention center.

Previously released court documents show Weakland oversaw a 1993 evaluation of Murphy that concluded the priest likely assaulted up to 200 students at the school.

Weakland resigned as archbishop in 2002 after admitting the archdiocese secretly paid $450,000 to a man who accused him of sexual abuse
