Ghana:BNI And Attorney-General Fail To Show Up In Court



The Attorney General and the BNI failed to show up in court today, Wednesday, 15th July, 2009 in a case in which the Greater Accra Regional Chairman of the NPP, Sammy Crabbe, is seeking an order to restrain the BNI from preventing invitees from going with their lawyers. Mr Sammy Crabbe is asking the Human Rights Division of the High Court to stop the BNI and the Attorney General from violating the fundamental rights of invitees. Article 14, clause 2 of the 1992 constitution, guarantees the right of every citizen to a lawyer, but when citizens are invited by the BNI they are not allow to sit with their lawyers when they are being questioned by the BNI. And this, according to the NPP Chairman, is unconstitutional.

Both the BNI and the Attorney-General did not show up when the case was called by the presiding judge, and no reason was given for non appearance of the BNI and the Attorney General. The court, presided over by the Mr Justice Paul Dery adjourned the case for ruling on 28th of this month, after hearing the submission of counsel for Mr Sammy Crabbe.

What are they afraid of? In the democratic world the best place to prove your case is the court so why is the BNI and the Attorney General dragging their feet? Why don't they go to court to defend their actions if they think they are right to invite people for questioning without the presence of their lawyers?

It is absurd that those who want to run Ghana like a banana republic are afraid to go to court to defend their actions.

Ghanaians must resist every attempt to use the BNI to either harass or intimidate the people no matter their political, regious or ethnic leanings. BNI is aware that it is not the constitutionally mandated body to handle corruption allegations in the country. CHRAJ and the Serious Fraud Office are the institutions charged with those functions. The failure of the BNI and A-G to appear in court without any reason is a clear admission of guilt on their part.
